Her Ladyship the Hon. Chief Justice Mrs. Justice Irene C. Mambilima, accompanied by Hon. Mr. Justice Charles Zulu, and Mr. Lameck Ng’ambi – Sheriff of Zambia, attended the IX International Theoretical and Practical Conference on Issues of Enforcement/Execution of Judicial Acts or Acts of Other Authorities, under the theme “State and Private Enforcement Systems: Comparative Analysis and the Best Practices”, held in the resort town of Sochi, Russia, from 10th -13th October 2018.
In her presentation to the conference, the Hon. Chief Justice addressed a number of areas such as Duties of the Sheriff and his or her Officers, Property Liable to Execution, Obligation on the Sheriff to render reports after execution and time for enforcement of judgments, among other things.
Addressing members of the conference, the Hon. Chief Justice emphasized on the need for execution of court orders in the course of justice, when she said that “the bedrock and the essence of civil and commercial litigation is enforcement and execution of court decisions or orders. A successful litigant at the end of the litigation process must be guaranteed the right to enjoy the fruits of his or her judgment. The unjustified systemic or otherwise failure to enforce court orders is not only a mockery of justice, but an act of injustice”. She further highlighted to the participants of the conference on the sources of authority that may empower the office of the Sheriff of Zambia to levy execution as the Sheriff’s Act, the High Court Rules, and the Subordinate Courts Rules as well as other relevant statutes.
