SWEARING-IN OF MEMBERS OF THE CAPITAL MARKETS TRIBUNAL

Lusaka, 18th June 2024 – Her Ladyship Hon. Justice Judy Zulu Mulongoti, Hon. Judge of the Constitutional Court, this morning swore-in three members of the Capital Markets Tribunal, an adjudicative body established pursuant to the Securities Act No. 41 of 2016.

The mandate of the tribunal is to among others, hear and determine appeals from decisions of the Securities and Exchange Commission; address cases of misconduct in the Securities market; and handle other matters specified in the Securities Act or any other written law relating to Securities in Zambia.

In her address, Justice Mulongoti extended her congratulations to the reappointed members, noting that their reappointment reflects the confidence that the appointing authority has in their capabilities and the commendable work they have accomplished since the tribunal’s inception in 2021. “I am reliably informed that the tribunal has so far dealt with ten cases, with seven already disposed of. Congratulations on this achievement, as the nature of the cases you have handled is quite complex,” she remarked. This milestone, she added, also demonstrates the public’s trust in the tribunal as an effective appellate body for the Securities and Exchange Commission.

Justice Mulongoti reminded the tribunal members of their critical role as a quasi-judicial body, emphasizing the importance of dispensing justice independently and impartially. She highlighted the public’s expectation for the swift resolution of disputes and urged the members to uphold their responsibility as a fast-track commercial dispute resolution tribunal in the capital markets sector.

The members of the Capital Markets Tribunal sworn in are as follows:
